Official Rules for the BOMBAY SAPPHIRE® Artisan Series Contest

There is no purchase necessary to enter.

  • 1. Eligibility: The Contest is open only to legal residents of the fifty (50) United States and the District of Columbia (except residents of Utah) who are at least twenty-one (21) years old. Employees of Bacardi U.S.A., Inc. (“Sponsor”), Commonground (“Administrator”), or any of their respective distributors, wholesalers, retailers (including bartenders/staff), or licensees, as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter.

  • 2. Artwork and Entry Requirements:

  • a. Create an original piece of visual art that is inspired by your imagination (your “Artwork”). The Artwork may not be a reproduction of any existing work. We’ll accept any visual art format, except film. Once your Artwork is complete, take a high-resolution picture of your Artwork. The picture will constitute your “Entry”. The Entry must be in JPEG format.

    b. Neither your Artwork nor your Entry may: (i) be targeted to people under twentyone (21) years old; (ii) feature people who are under twenty-five (25) years old; (iii) encourage, condone, promote, or glamorize under-age, excessive, or irresponsible consumption of alcohol products, drunk driving, or any behavior considered to be anti-social, illegal, or immoral or suggest that the consumption of beverage alcohol will lead to social or sexual success; (iv) violate anyone else’s rights, including their copyrights, trademark rights, or rights of privacy or publicity; or (v) contain any defamatory statements or threats. In addition, your Entry must comply with the Code of Responsible Practices for Beverage Alcohol Advertising and Marketing of the Distilled Spirits Council of the United States, Inc.

  • 3. How to Enter:

  • a. Visit or and follow the instructions to fill out the entry form and submit your Entry. Only Entries submitted between 12:00:01 AM ET on June 3, 2013 and 11:59:59 PM ET on August 30, 2013 will be eligible. You may submit multiple Entries, but each Entry must be a picture of a different Artwork.

    b. All Entries that comply with these Official Rules will be included in an online competition, as described below. In addition, if you live within one hundred (100) miles of one of the following Local Markets, you will be included in a competition associated with that Local Market: Atlanta; Chicago; Dallas; Detroit; Houston; New Orleans; New York; San Francisco; and Washington, DC.

    c. By entering, you represent and warrant that: (i) you accept these Official Rules and Sponsor’s decisions regarding the Contest; (ii) both your Artwork and Entryare original works that have not previously been published or displayed in any medium; (iii) you own all rights to the Artwork and Entry.

    d. Sponsor reserves the right to edit or reject any Entry that doesn’t comply with these Official Rules or that, in Sponsor’s sole discretion, is in bad taste.

  • 4. Sponsor’s Rights to Entries: You do not transfer ownership of your Entry by entering the Contest. However, by entering, you: (a) irrevocably grant Sponsor, its agents, licensees, and assigns the unconditional and perpetual exclusive right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, exhibit, and otherwise use your Entry (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party; (b) forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude Sponsor’s use of your Entry, or require any further permission for Sponsor to use the Entry; and (c) agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Sponsor on the grounds that any use of the Entry, or any derivative works, infringes any of your rights as creator of the Entry, including, without limitation, copyrights, trademark rights, and moral rights.

  • 5. Local Market Winner Selection: The following procedures will apply for entrants who live within one hundred (100) miles of one of the Local Markets defined above (“Local Market Territory”).

  • a. First Round: A panel of judges in each Local Market will review all Entries submitted within the Local Market Territory according to the following Judging Criteria: (i) innovation; (ii) aesthetics; and (iii) imagination. The judges will select between 20-40 Finalists in each Local Market Territory based on the highest scores. The number of Finalists will depend on the size of the art gallery described below.

    b. Second Round: Sponsor will contact the Finalists in each Local Market Territory and invite them to participate in an event at a local gallery. The event will take place between September 19, 2013 and November 8, 2013, but the Finalists will be given a precise date, time, and location during the communication. Each Finalist is responsible for bringing his/her Artwork to the gallery seven (7) days before the event and for transporting the Artwork back home after the event. At the event, a panel of judges will evaluate each Finalist’s Entry according to the Judging Criteria and select one (1) potential winner based on the highest scores. Finalists will be required to sign the described in Section 7.

  • 6. Online Winner Selection: The following procedures will apply for all entrants.

  • a. Judging: On or about November 9, 2013, a panel of judges will review all Entries according to the Judging Criteria and select one (1) potential winner based on the highest scores.

    b. Voting: Between 12:00:01 AM ET on September 9, 2013 and 11:59:59 PM ET on November 8, 2013, Entries that comply with these Official Rules will be posted on and website visitors will be able to vote for their favorite Entries based on the Judging Criteria. There is a limit of one (1) vote per person, per entry, per day, and a person may only use one e-mail address to vote. Please see additional information about the voting process below. The two (2) entrants with the highest number of votes shall be deemed potential winners. In the event of a tie, the potential winner will be selected by a panel of judges based on the Judging Criteria. If the potential winner has already won a prize in this Contest, the prize will be awarded to the person with the next-highest score.

    c. Voting Process: You may not attempt to obtain votes by any fraudulent or inappropriate means, including, without limitation, by: (i) circumventing (or encouraging others to circumvent) the vote limits; (ii) using any automated system to vote; or (iii) offering any inducements to others in exchange for votes; or (iv) using proxy voting schemes in which anyone other than the actual person submits the vote. Sponsor, in its sole discretion, reserves the right to reject any votes that Sponsor has reason to believe were obtained through fraudulent or inappropriate means.

  • 7. Potential Winner Requirements: In order to win a prize, a potential winner may be required to complete and return the following documents: (a) a declaration of eligibility and release; and (b) a license confirming the rights described above in Section 4. This does not affect a potential winner’s rights to the underlying Artwork. If a potential winner fails to sign and return the documents within five (5) days of the date the documents are mailed or presented, he/she will forfeit the prize and an alternate potential winner may be selected in his/her place according to the Judging Criteria.

  • 8. Prizes: The nine (9) winners in the Local Markets (one (1) per Local Market) and the three (3) online winners will each receive a trip to Miami to attend SCOPE MIAMI BEACH 2013 on or about December 5 to December 8, 2013.

  • a. The trip will include: (i) round-trip coach-class airfare for the winner from a major airport near the winner’s home in the contiguous United States to Miami (if necessary); (ii) hotel accommodations for (2) nights; and (iii) ground transportation to/from hotel/airport/event. If a winner lives within 150 miles from Miami, the prize will not include air transportation. If a winner lives in Alaska or Hawaii, he/she will be responsible for getting to the contiguous United States.

    b. Sponsor will work with each winner to have his/her Artwork shipped to Miami for the event by November 26, 2013 and back to the winner on or about December 20, 2013. Sponsor will cover shipping costs and up to $10,000 in shipping insurance.

    c. The approximate retail value of each prize is $2,500. The actual value of the trip will vary depending on various factors, including the point of departure. No difference between the approximate and actual value will be awarded. A winner isresponsible for paying any applicable income taxes and any and all other costs and expenses not listed above. Any prize details not specified above will be determined by Sponsor, in its sole discretion. A prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion.

  • 9. General Conditions: In the event the operation, security, or administration of the Contest is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest; or (b) award the prizes according to the Judging Criteria (with or without reference to the public votes) from among the Entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Contest, violates these Official Rules, or acts in a disruptive manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt. In the event of a dispute as to the owner of an Entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner. The Contest is subject to federal, state, and local laws and regulations and is void Utah and where prohibited.

  • 10. Release and Limitation of Liability: By entering, you agree to release and hold Sponsor, Administrator, Facebook, the Contest judges, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) harmless from and against any and all liability, claims, actions, loss, harm, damage, injury, cost or expense (collectively, “Claims”) arising out of your participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest (including the voting process); (b) technical errors; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of Entries; or (f) injury or damage to persons or property. You further agree to indemnify, release, and hold the Released Parties harmless from any Claims that their use of your Entry or Artwork (as contemplated herein) violates or infringes upon the rights of any third party.

  • 11. Privacy and Publicity: Any information you submit as part of the Contest will be treated in accordance with Sponsor’s Privacy Policy. The information you provide when you enter is provided to Sponsor, not to Facebook.

  • 12. Disputes: Except where prohibited, you agree that any disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Florida. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Florida, without givingeffect to any choice of law or conflict of law rules (whether of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Florida.

  • 13. Winners: For the names of the winners, send a self-addressed stamped envelope to “2013 BOMBAY SAPPHIRE® Artisan Series Contest Winners, Commonground, 600 West Fulton, 4th Floor, Chicago, IL 60661.” Requests must be received by February 28, 2014.

  • 14. Sponsor: The Contest is sponsored by Bacardi U.S.A., Inc., 2701 South Le Jeune Road, Coral Gables, FL 33134. This Contest is in no way sponsored by, endorsed by, administered by, or associated with, Facebook.
